Terms of Service

These Terms govern your use of the 9am service at nova.9am.works, operated by 9am GmbH, c/o AchtBerlin, Schönhauser Allee 8, 10119 Berlin, Germany ("9am", "we", "us"). By creating an account you agree to these Terms and our Privacy Policy.

1. Service description

9am is a freelancer-first tool that ingests public job listings, helps you tailor a CV and cover letter, sends applications, tracks their status, and collects references. 9am is currently offered free of charge; paid features may be added later and will be disclosed before purchase.

2. Eligibility and account

You must be at least 18 years old and legally able to enter into a binding contract. You are responsible for the accuracy of the information in your account and for keeping your credentials secure. One account per person; automated or shared accounts are not permitted.

3. Your content

You retain all rights in the content you upload or create in 9am (profile, CV, cover letters, CRM notes, references). You grant 9am a non-exclusive, worldwide, royalty-free licence to host, store, process, display, and transmit that content solely to operate the service for you, including sending applications on your instruction and rendering your public profile if you have enabled it.

You warrant that you have the right to upload the content you provide, including CV content of third parties (colleagues, hiring managers, reviewers) whose information you enter, and that this content does not infringe third-party rights or applicable law.

4. Acceptable use

You must not:

• send unsolicited bulk messages or spam hiring managers;
• scrape, mirror, or otherwise copy 9am or its data;
• impersonate another person or misrepresent your professional history;
• upload illegal, defamatory, or infringing content;
• attempt to disrupt or circumvent the security of the service.

5. Applications and hiring-manager contact

When you send an application "via 9am", 9am forwards your message and CV to the recipient on your behalf. When you use the "own email" flow, the message is sent from your own email client and 9am is not the sender. In both cases you are responsible for the content of your message.

6. AI features

9am uses AI to generate suggestions such as tailored CVs, match scores, and interview questions. AI output can be inaccurate, biased, or outdated. You are responsible for reviewing and editing any AI output before sharing or sending it. 9am is not liable for the content of AI-generated text that you choose to send.

7. Public profile

If you enable your public profile, the fields you have marked public will be reachable at a public URL and may be indexed by search engines. You are the publisher of that content and can withdraw it at any time by making the profile private.

8. Fees

9am is currently free of charge. If we introduce paid plans, the price and scope will be shown before you subscribe, and payment terms will supplement (not replace) these Terms.

9. Termination

You can delete your account at any time from settings or by writing to support@9am.works. We may suspend or terminate access for material or repeated breach of these Terms, giving you notice unless immediate action is required.

10. Warranty and liability

The service is provided "as is" during the current free/beta phase. To the extent permitted by law, 9am's liability for slight negligence is excluded except for damages arising from injury to life, body, or health, or from breach of a material contractual obligation, in which case liability is limited to typical, foreseeable damage. Liability under the German Product Liability Act remains unaffected.

11. Changes to the service and to these Terms

We may modify the service and, with reasonable prior notice, these Terms. If a change disadvantages you, you may terminate your account before it takes effect. Continued use after the effective date counts as acceptance.

12. Governing law and venue

These Terms are governed by German law, excluding the UN Convention on Contracts for the International Sale of Goods. For merchants, legal entities under public law, and special funds under public law, the exclusive place of jurisdiction is Berlin. Mandatory consumer protection provisions of the country in which you have your habitual residence remain unaffected.
